Prison rape is cultural and should not be used to argue against rape as a problem primarily affecting women. Prison rape is not normal across the Wester world. The United States is an outlier. It has an extremely punitive justice system imprisoning more people than even the worst dictatorships and where there is a culture that sees prisoners as animals and not worth of normal human rights. It is in such a context that prison rape becomes prevalent in the US. The welfare of prisoners is simply not important in the US.
So I do not believe prison rape should part of the general discussion on rape because it is 1) A US specific problem and 2) primarily an outcome of dehumanization of prisoners. It is better to deal with prison rape as part of a genera humanization of US prison system rather than treating it as an integral part of the discussion about rape.
Yes, most sex is consensual but it is shocking how much rape there is and how easily rapist walk. There was a brutal case where a girl even broke her jaw. The violence to her body suggested it was obviously rape. And they had the DNA evidence. In the end he walked by just claiming it was consensual. To explain the violence to her body he brushed it off by saying "We had BDSM."
In a world where walking free is that easy, it is crazy to suggest women must be punished severely if they are mistaken in a rape case.
We don't live in a perfect world. Some women will deliberately falsely accuse you. But the chance of a conviction is next to none given that real rapist walk most of the time.
It can hurt reputation but you can charge her for slander. One is not defenseless against false accusations.
